Please read them together with our Privacy Notice, Refunds, Withdrawals & Deferrals policy, Learner Code of Conduct, Assessment & Certification policy and Responsible AI Use policy, which form part of these terms.
2. Applications
You can apply for a course through our website, by phone or through our admissions team. Applying is free. When you apply:
- the information you give must be accurate and your own;
- you must meet the minimum age for the course. Our standard minimum enrolment age is 18. See our Safeguarding & Under-18s policy;
- we review your application and may contact you to discuss whether the course suits you.
We may decline an application, for example where a course is clearly not suitable for you, the cohort is full, or the information provided is incomplete or inaccurate. We will tell you if we decline your application. An application does not enrol you, create an account or create any obligation to pay.
3. Enrolment
Your place on a course is confirmed when both of the following have happened:
- we have accepted your application and confirmed the course, cohort and fee in writing; and
- your first payment under your chosen payment plan has cleared, or a sponsor or employer has confirmed in writing that it will pay.
Once enrolled, you will receive access to our learning platform and the cohort’s live sessions. Your account is personal to you. Do not share your login details or let anyone else attend or submit work in your name.
4. What we provide
For each course, we will provide the live sessions, mentor reviews, practical briefs, learning materials and support described on the course page at the time you enrol. Most programmes are delivered live online, with some self-paced material on our learning platform.
We will deliver our services with reasonable care and skill, using instructors and mentors with relevant practical experience.
5. Changes to a course
Practical courses must keep up with the tools and practices used at work, so we may update course content, tools, instructors, mentors or session times. When we do:
- we will tell you as early as we reasonably can;
- we will keep the overall learning outcomes and level of support materially the same; and
- if a change significantly affects you, for example a change of schedule you cannot attend, we will offer you a transfer to another cohort or the options set out in our Refunds, Withdrawals & Deferrals policy.
6. Your responsibilities
As a learner, you agree to:
- attend live sessions and complete the projects and assessments for your course;
- follow our Learner Code of Conduct and Responsible AI Use policy;
- submit work that is honestly your own, with any permitted help or AI use disclosed as required;
- keep course materials, recordings, cohort chats and other learners’ work inside your cohort, unless the owner agrees otherwise;
- arrange suitable equipment and internet access for live online learning; and
- keep your contact details up to date so we can reach you about your course.
7. Intellectual property
Our materials
Our course materials, recordings, briefs, templates, slides and platform content belong to Elimu Sasa or our licensors. We give you a personal, non-transferable licence to use them for your own learning while you are enrolled and afterwards for your personal reference. You may not copy, sell, publish or share them outside your cohort without our written permission.
Your work
You own the original work you create on a course. You give us permission to access, copy and review it for teaching, assessment, mentor review, certificate verification and quality assurance. We will only publish your work, or show it to employers, if you ask us to or give separate permission, for example through a graduate portfolio. Work you create for a real client may also be subject to that client’s rights, which you should agree with them.
8. Artificial intelligence
Elimu Sasa is deliberately AI-enabled. AI is taught in some programmes, and you may be encouraged to use AI tools in your work. How you may use AI in each assessment is explained in our Responsible AI Use policy. AI may assist your work. It does not replace your responsibility for the work. How we use AI with personal information is explained in our Privacy Notice.
9. Fees and payment
- Fees, payment plans and any discounts are shown on our website or confirmed to you in writing by our admissions team before you enrol.
- Where you pay in instalments, each instalment must be paid by its due date. If an instalment is not paid, we may pause your access to live sessions and the learning platform after giving you notice and a reasonable chance to pay.
- Where a sponsor or employer pays, you remain responsible for any amount the sponsor does not pay, unless we agree otherwise in writing.
- Payments are processed by payment providers such as mobile money, card or bank services. We do not store your full card details.
- Any third-party software licences or subscriptions you need for a course are explained on the course page.
10. Cancellation, withdrawal and deferral
Our Refunds, Withdrawals & Deferrals policy explains what happens if you cancel before a course starts, withdraw during a course, need to defer to a later cohort, or if we postpone or cancel a cohort.
11. Conduct, suspension and removal
We may suspend or end your participation if you seriously or repeatedly breach our Learner Code of Conduct, for example through harassment, serious academic dishonesty or sharing other people’s personal information. Except where urgent action is needed to keep people safe, we will tell you about the concern and give you a chance to respond first. The consequences for fees are set out in our refunds policy.
12. Employment and business outcomes
Elimu Sasa does not guarantee employment, salary, clients, business success or placement.
What we do commit to is the training, mentor review, practical portfolio work and, where they fit, introductions to employers or opportunities described for your programme. Outcomes depend on many things, including your effort, the job market and decisions made by employers and clients. Any learner stories or results we share describe individual experiences, not a promise of the same result.
13. Third-party services
We use third-party services to deliver our courses, for example video conferencing, messaging, payment, email and software tools. Your use of those tools may also be subject to their own terms. We choose reputable providers, but we are not responsible for their services beyond our own obligations under these terms and the law.
14. Interruptions
We work to keep our websites, learning platform and live sessions available, but interruptions can happen, for example because of internet or power outages, provider failures or events outside our reasonable control. Where a live session is significantly disrupted, we will reschedule it, provide a recording where available, or provide equivalent support.
15. Limits on our responsibility
We are responsible for loss you suffer that is a reasonably foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for:
- loss that was not reasonably foreseeable;
- business losses, such as lost profit, contracts or opportunities, where you use our services for business purposes; or
- delays or failures caused by events outside our reasonable control.
Where the law allows a limit, our total responsibility to you in connection with a course is limited to the fees you paid for that course. Nothing in these terms limits or excludes any liability or right that cannot be limited or excluded under Kenyan law, including rights you have as a consumer.
16. Complaints
If you are unhappy with any part of our service, please tell us at info@elimusasa.com or through our Report a Concern page. We will acknowledge your complaint, look into it fairly and respond within a reasonable time, usually within five working days. If you remain unhappy, you can ask for the decision to be reviewed by a senior member of the Elimu Sasa team. Concerns about personal information can also be raised with the Office of the Data Protection Commissioner.
17. Governing law
These terms are governed by the laws of Kenya. Disputes will be dealt with by the courts of Kenya, although we will always try to resolve a concern with you directly first.
18. Changes to these terms
We may update these terms from time to time, for example to reflect changes to our courses or the law. The version and date at the top of this page show when they last changed. Changes will not apply to a course you have already enrolled on unless the change is required by law or is in your favour, or we have told you and you have agreed.
